GENERAL CONDITIONS OF SALE
SCOPE
These Terms and Conditions (from now on the "General Conditions of sale") govern all sales contracts concluded between: - first the natural or legal persons wishing to make a purchase via the Website BEAUTY PRO SOLUTION, hereinafter referred to as "Customer". - And, secondly, the company BEAUTY SKIN SOLUTION SAS with capital of 10,000 euros, whose registered office is at: 9 RUE EUGENE MANUEL 75116 PARIS - France, registered with the RCS of Paris under number SIREN 881 573 992 and VAT FR 13881573992, hereinafter referred to as "BEAUTY SKIN SOLUTION". Any order on the Website www.beautyprosolution.com necessarily implies the acknowledgement by the Customer of these General Conditions of sale prior to ordering, and acceptance of all of their content. The acceptance of these General Conditions of sale shall take effect at the checkout.
BEAUTY SKIN SOLUTION reserves the right to modify at any time the General Conditions of sale. All changes and/or new terms and conditions will come into force from the moment of their publication on the Website. For this reason, Clients are invited to regularly access to the Website and to check the possible publication of updated General Conditions of sale.
1. REGISTRATION
Access to the services offered by the Website is reserved exclusively for users aged 18 and up years. To create your account, the Customer must fill in the form with all required information. The Customer will receive by e-mail a confirmation of registration.
During the registration is also required that the Customer accepts the General Conditions of sale. It is therefore understood that the non-acceptance of the General Conditions of sale will make it impossible to complete the registration process and, thereby, to make purchases on the Website.
By registering, the Customer confirms that provided information is true and complete. If contradiction in personal data was determined, BEAUTY SKIN SOLUTION reserves the right to ask for the documents to identity the customer and to suspend the validation of order.
Login information is confidential and inaccessible to any unauthorised third parties.
2. AVAILABILITY, PRODUCTS AND PRICES
The products covered by these Terms and Conditions are those listed on the Website. Products are offered subject to availability.
Each product has its code number and describes essential and basic characteristics. BEAUTY SKIN SOLUTION reserves the right to modify the photos. The image colour can be different with a colour of a product. BEAUTY SKIN SOLUTION cannot be responsible for variations in colour between the actual product and your screen.
The essential and basic characteristics of products are described and presented with the greatest possible accuracy. Differences between the products delivered and those shown on the Website or the Catalogue may exist, mainly for handicrafts for which the homogeneity of production can not be fully assured. These differences, since they do not relate to the essential characteristics of the products and do not affect their quality, can not justify cancellation of the order, refusal of delivery or refund of the product.
BEAUTY SKIN SOLUTION offers free shipping for France only. All product prices will be separately expressed in Euro and are inclusive of VAT (Value Added Tax).
The price of the products may be changed without notice. The price charged to the Customer will be published on the Website and reported on the order confirmation sent by BEAUTY SKIN SOLUTION. The products will remain the property of BEAUTY SKIN SOLUTION until full payment in received from the Customer.
Sometimes it is possible that the product is no longer available. If payment of the amount due for the product has already been made, BEAUTY SKIN SOLUTION would send the Customer an e-mail and would process the refund.
If the order contains multiple products, the unavailability of one or more of them couldn’t be a circumstance for a cancellation of the entire order. Partial reimbursement will apply on partial cancellations.
3. ORDER
Customer may execute his Internet order via www.beautyprosolution.com site. After the validation it is necessary to choose the address, mode of delivery, and confirm a payment method, this last step forms the Contract of sale with BEAUTY SKIN SOLUTION. Any order implies acceptance of prices and descriptions of products available for sale. The Contract will be effective after receiving an e-mail confirming the authorisation of the order by BEAUTY SKIN SOLUTION. In some cases, notably for non-payment, incorrect address or other problem with the account of a Client, BEAUTY SKIN SOLUTION reserves the right to block the order until the problem is resolved. The products offered on the Website www.beautyprosolution.com are accompanied by an indicative deadline of availability and the time of delivery. This information is updated regularly. The effective availability of a product can be changed rapidly depending on volume of sales or stock of the suppliers. BEAUTY SKIN SOLUTION can’t be held responsible if the indicative period of availability of the product and delivery is modified. If after the confirmation of a command the product couldn’t be available, BEAUTY SKIN SOLUTION will contact a Client as soon as possible by phone or by e-mail. The Customer may choose to keep the order or cancel it. BEAUTY SKIN SOLUTION will reimburse crediting the bank account no later than thirty (30) days of the Customer's payment.
4. RESPONSIBILITIES
BEAUTY SKIN SOLUTION has its responsibility during the order and after the contract with obligation of delivery. Thus BEAUTY SKIN SOLUTION undertakes to describe with great accuracy the products sold on the Website. However, the responsibility for BEAUTY SKIN SOLUTION not be held if the breach of its obligations would be due to an unforeseeable event and irresistible a third contract is a case of force majeure as defined by French jurisprudence. Similarly, the responsibility for BEAUTY SKIN SOLUTION not be engaged for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion, presence of computer viruses or failure of its host.
5. TYPES OF PAYMENT
BEAUTY SKIN SOLUTION offers their Customers attractive sales terms supported by appropriate payment methods:

The security is the first priority for BEAUTY SKIN SOLUTION, so your information is scrambled. All payments will be treated with LCL system which uses TLS Protocol, 3Dsecure Protocol and 15 security controls (as the control of bill or IP address).
It is up to the Customer to register and to print the payment form if he wants to keep the details of the banking operation relating to transaction.
A paper bill will be addressed with the merchandises.
6. DELIVERY: ACCEPTANCE OR REFUSAL
Goods are delivered to the address mentioned during the purchasing order. If the address is wrong, BEAUTY SKIN SOLUTION could not have responsibility for delivery. The expenses for the second delivery will be covered by a Client. BEAUTY SKIN SOLUTION is engaged to perform the delivery of ordered articles as soon as possible according to the chosen mode of delivery and of the availability of articles.
The delivery time is indicated for every merchandise. In particular cases the Client will receive a text message or an e-mail. This message will explain the particular circumstances (the stock of products, distance, disadvantaged zones, international delivery etc.).
The order sheet provided by a courier with a date and signature of a Client will constitute a proof of delivery.
During the reception of products, it is up to the Client to check the articles to be sure that the delivered products correspond to its order. The Client (or the addressee) will formalise his acceptance of delivery by the signature of the order sheet provided by the courier. Once the Client signs an order sheet, the delivered package is distributed and the client won’t be able to return it.
The Client or his representative must open the package in the presence of the courier to check the Products. If the product is damaged during transportation, the Client must refuse the products and mark in the order sheet "refused because of the damage".
For any claim relating to a visible defect or to damage during the delivery of the product, the Client must contact Customer service of BEAUTY SKIN SOLUTION as soon as possible, and to initiate the return.
In the case of a refusal of the Product and its return (for reasons of previous paragraph), the Client will be able to ask for a new delivery or to cancel his order.
All delays are pointed out on the site www.beautyprosolution.com and considered in working days. BEAUTY SKIN SOLUTION will inform Client by e-mail about possible delivery delay of merchandises, and will find a way to inform about the progress of delivery.
In case of absence of a Client or his representative during delivery, the courier will leave a letter with a description where the order can be found and under which circumstances it can be taken. If the Client doesn’t recuperate his goods, BEAUTY SKIN SOLUTION reserves the right to reimburse its price, but the expenses of return must be payed by the Client.
7. RIGHT OF RETURN AND EXCHANGE
In accordance with French Law N° 2014-344 of March 17th, 2014 relating to consumers rights, individual (not professional) Client has fourteen (14) working days following the day of delivery of his order, to exercise his return right without obligation to justify motives. The product must be returned within fourteen (14) days, correctly protected by its original pack and in its origin state, accompanied with all possible accessories, notes and documents. The product must be never used and must be in a perfect cleanness state. The Client must inform the Customer service of BEAUTY SKIN SOLUTION about the return of purchases by e-mail at: beauty.skin.solution88@gmail.com and after send the goods to the following address: 9 RUE EUGENE MANUEL 75116 PARIS, accompanied with the order form or with the copy of the bill of sale.
All expenses and risks linked during return are covered by a Client. In case of litigation, the Client must be able to give a proof of postage. BEAUTY SKIN SOLUTION will reimburse the price of merchandises to Client as soon as possible (the latest during thirty (30) days after the day of reception of the returned articles). Expenses for return are payed by Client.
Return right does not apply to the perishable goods which cannot be redirected and goods which are made individually for the Client (for example with personal dimensions).
8. CLAIMS ON «GUARANTEE OF COMPLIANCE» OF NOT PROFESSIONAL CLIENTS
All products supplied by www.beautyprosolution.com benefit from legal warranties considered and covered by articles 1641 and following the French civil code.
If the merchandises were not orders but received, the Client must contact BEAUTY SKIN SOLUTION and to send back the products. The expenses for return are payed by BEAUTY SKIN SOLUTION.
- Incorrect reference or wrong quantity
If the products were delivered in a wrong quantity, the problem must be resolved and the expenses will be covered by BEAUTY SKIN SOLUTION.
If the references of the merchandises are incorrect, the expenses for return will also be covered by BEAUTY SKIN SOLUTION.
- Transport damage:
Prerequisite for a refund or replacement of the goods:
During delivery, the Client or his representative must control the goods in the presence of the duly authorised courier.
In case of damage due to the transport the Client must expressly notify reservations to be made for the delays allowed to the courier, and to send a copy to BEAUTY SKIN SOLUTION, otherwise BEAUTY SKIN SOLUTION can refuse the refund or replacement of products.
General conditions for reimbursement or replacement of goods
During delivery, the Client or his representative must verify the merchandises in the presence of courier.
In case of damage during transportation, the Client must notify the courier, and to send a copy to BEAUTY SKIN SOLUTION. If this condition is not respected, BEAUTY SKIN SOLUTION reserves its right to refuse return, and refuse to reimburse the price or change the products.
Return of goods
Every product accepted for return but damaged at arrival to BEAUTY SKIN SOLUTION, couldn’t be neither refunded nor returned for sales.
Guarantee of compliance
In case of not compliance of a sold product, it can be sent back to BEAUTY SKIN SOLUTION, for being exchanged or reimbursed.
All claims for defects of compliance, requests for exchange or reimburse must be sent within thirty days after delivery to the following address: 9 RUE EUGENE MANUEL 75116 PARIS, France.
9. REFUNDS
In the event of unavailability of the product or withdrawal of the Client, as it can be better regulated in these General Conditions of Sale, BEAUTY SKIN SOLUTION will refund the client the amount paid at the time of purchase.
A refund may be made within the period of 30 days from the date of actual receipt of payment by the Client, through the same method of payment as it has been received.
10. FORCE MAJEURE AND NATURAL DISASTERS
In these cases of force majeure, of strikes of transport, blockages of roads, natural disasters or impossibility of circulation, BEAUTY SKIN SOLUTION is not responsible for delays or for absences of delivery.
11. DATA PROTECTION ACT
The information requested by BEAUTY SKIN SOLUTION is essential to managing the order of the Client. In accordance with the "information and freedoms" of 6 January 1978, the processing of personal information is the subject of a declaration to the Commission Nationale Informatique et Libertés (CNIL) under number 1808692V0. Thus the Client has at any time the right to access, modify, correct and delete data relating to BEAUTY SKIN SOLUTION. He can exercise by sending the application by e-mail via the contact form available on the Website www.beautyprosolution.com. Depending on the selection made by the Client when creating or modifying an account, he could receive information and commercial offers from BEAUTY SKIN SOLUTION and other companies. The Client may at any time choose not to receive such information and commercial offers of BEAUTY SKIN SOLUTION either modifying its selection on the site www.beautyprosolution.com in the "Your Account" or by specifying its query via the form Contact this on the Website.
12. APPLICABLE LAW
These Conditions of Sale shall be executed and interpreted according to French law. The parties shall seek in any dispute an amicable agreement. If it is impossible, the exclusive jurisdiction is attributed to the courts of the headquarters of BEAUTY SKIN SOLUTION.
13. INTELLECTUAL PROPERTY
Elements edited on the site of BEAUTY SKIN SOLUTION notably including logos, recorded marks, texts, photographs, pictures, drawings, models are protected by intellectual property rights. Reproduction or representation, complete or partial, of this Website is therefore forbidden without the agreement of the holders of these rights and would constitute a counterfeiting punished by the dispositions of the Code of intellectual property.
